.... .... Respondent/s =========================================================== Appearance :

For the Petitioner/s : Mr. Shashi Bhushan Kumar, Advocate For the State : Mr. P.K.Verma, AAG-3 Mr. S.K.Sharma, AC to AAG-3 =========================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE and HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) Date: 31-01-2017 The grievance of the petitioner in the present Public Interest Litigation is that the circle rate of Jai Nagar Nagar Parishad is more than the circle rate fixed in the district headquarter town of Madhubani.

We do not find any merit in the argument raised. The Circle rate is dependent upon past transaction of sale and other factors for determining the circle rate. We do not find that merely

Patna High Court CWJC No.3568 of 2016 dt.31-01-2017 because the circle rate is higher of a town bordering Nepal which is hub of commercial activity than the District headquarter town, Madhubani, it cannot be said that the circle rate of Jai Nagar Nagar Parishad is illegal and arbitrary.

We do not find any reason to interfere in writ jurisdiction of this Court.

The writ application is thus dismissed.
