2. The petitioners seek bail in connection with Kusheshwar Asthan P.S. Case No. 356 of 2023 registered for the offence under Sections 399/402 of the Indian Penal Code and under Section 25(1-b)a, 26/35 of the Arms Act.

3. As per the prosecution case, eight criminals were caught planning a loot.

4. The petitioners are in jail since 30.10.2023.

5. It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and the recovery of pistol and cartridge is from one Mohammad Dilshad.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 356 of 2023.

8. As a condition of this order, the petitioners after being released on bail are directed to mark their attendance at Kusheshwar Asthan Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioners. (Sandeep Kumar, J) Vikas/- U T
