The petitioners apprehend arrest in a case registered for the offences punishable under section 379, 504 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.
The petitioners are named in the F.I.R. but no specific allegation is made. All the 33 accused persons are alleged to have made indiscriminate firing but none was injured. The informant alleged that his land was ploughed. On the other hand, accused Indal Yadav also lodged a counter version of the case and the same and similar
Patna High Court Cr.Misc. No.28639 of 2015 (2) dt.23-07-2015 allegation has been levelled against the informant and others who made indiscriminate firing and damaged the crops of land of Indal Yadav.
Considering the facts aforesaid, and that from both sides it is alleged that firing was made but none was injured, let the above named petitioners, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Biraul, Darbhanga in connection with Kusheswar Asthan P.S. Case no. 244 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
