Petitioner apprehends his arrest in connection with Amba P.S. Case No. 22 of 2016, registered under Sections 147, 148, 149, 448, 341, 323, 325, 307, 379, 354, 504 and 506 of the Indian Penal Code.

Petitioner is named in the First Information Report and it is alleged that all the F.I.R. named accused persons went at the house of the informant and co-accused Yogendra Singh, Rahul Kumar, Roshan Kumar and Deepak Kumar @ Sani assaulted the injured persons of this case by means of different weapons and subsequently, all the F.I.R. named accused, having entered into the house of the informant, snatched a gold chain and other articles. Patna High Court Cr.Misc. No.24711 of 2016 (2) dt.14-06-2016 2/2 specific overt act has been attributed against the petitioner and he is only said to be a member of mob but as a matter of fact, the petitioner has been implicated in this case on account of previous enmity. From reading of para-3 of the petition, it shows that petitioner does not have any criminal antecedent and moreover, according to the informant's case itself, at the time of alleged occurrence, petitioner was unarmed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in Amba P.S. Case No. 22 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
