This is an application for bail in connection with Bettiah Town P.S.Case No. 558/2017 registered for the offences punishable under section 30(a) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is of recovery of 413 litres of liquor from a vehicle and the petitioner was arrested at the spot alongwith other co-accused.

Submission of the learned counsel for the petitioner is that the petitioner is only servant of a co-accused and he has nothing to do with the seized articles and he is in custody for two and half months having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of huge quantity of

No.48336 of 2017 (2) dt.12-10-2017 recovery, this application is disposed of with a direction to the trial court that once charge has been framed in this case or the petitioner completes the period of three months in judicial custody, whichever is earlier, the petitioner shall be released on bail by the trial court to its satisfaction.
