The petitioner is in custody since 07.05.2018, in connection with Bihra P.S. Case No. 85 of 2018, for the offence registered under Sections 399, 402 of the I.P.C and 25(1-B)a, 26, 35 of Arms Act under Section 3⁄4 Explosive Substance Act and Section 20 and 22 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that no recovery of any psychotropic substance has been made from his possession rather the alleged recovery was made from possession of one Badri Yadav, and he is languishing in jail. It is further submitted that save and except present case he has no criminal antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.45857 of 2018(2) dt.16-08-2018 2/2 the case that only 900 gm of ganja was recovered which is less than commercial quantity, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge I/c, Saharsa, in connection with Bihra P.S.
