JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-06-2016 Heard learned counsel for the petitioner and learned counsel appearing for the State.

Petitioner apprehends his arrest in connection with Chewara P.S. Case No. 5 of 2016, registered for the offences punishable under Section 414/34 of the Indian Penal Code. According to the prosecution case, one vehicle laden with Cow was seized by Police Officials of Chewara Police Station on 13.03.2016. Petitioner happens to be owner of the said vehicle and submission on behalf of the petitioner is that the driver of the aforesaid vehicle proceeded with the vehicle to Jamui on 11.03.2016, but till 12.03.2016 the aforesaid driver did not return and after that, on 12.03.2016, petitioner gave a written report regarding missing of driver and his vehicle to the Officer-incharge of Laheri (Biharshariff) Police Station and after filing of

Patna High Court Cr.Misc. No.24905 of 2016 (2) dt.16-06-2016 2/2 the aforesaid written report, the vehicle was seized by Police Officials of Chewara Police Station.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheikhpura in Chewara P.S. Case No. 5 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
