Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Khizersarai P.S. Case No. 234 of 2017 registered under Sections 147, 148, 149, 323, 341, 379, 427, 354A, 447 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

At the instigation of the petitioner, other accused persons named in the F.I.R. resorted firing intruding into the house of the informant and damaged the same. Lalu Yadav assaulted on the face of his son by means of butt of the pistol and Santosh

It is submitted by learned counsel for the petitioner that there is no overt act against the petitioner. The petitioner is said to be only order giver. The allegations levelled against other accused persons are omnibus in nature. The petitioner has been languishing in custody since 08.09.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Gaya in connection with Khizersarai P.S. Case No. 234 of 2017.
