JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Deo P.S. Case No. 50 of 2017, registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code.

Allegedly, the informant was going on his home by tempo and on the way he parked his tempo and went for taking mobil from spare parts shops and in the meantime the tractor driver Dhirendra Singh raised alarm and started assaulting and abusing

Patna High Court Cr.Misc. No.51972 of 2017 (2) dt.09-11-2017 2/3 the informant, he called villagers and villagers brutally assaulted and snatched Rs. 8000/- from the pocket.

Submission is of false implication and that there is case and counter case. For the same date of occurrence Dhirendra Singh has filed case against the informant and others vide Deo P.S. Case No. 51 of 2017. Dhirendra Singh has sustained grievous injury. In this case there is allegation for assaulting the informant with fists and slaps for parking of tempo. In the injury report of the informant, the doctor has found simple injury, both sides have sustained injuries. In this case other co-accused Sunil Kumar Singh @ Sunil Singh, Jay Ram Singh and Dhirendra Singh @ Dhirendra Kumar Singh have been allowed pre-arrest bail vide Cri. Misc. No. 37027 of 2017 and further Pandit Singh @ Harendra Singh and Amit Singh @ Buchan Singh have been allowed pre-arrest bail vide Cri. Misc. No. 41291 of 2017 and, as such, the petitioners deserve sympathetic consideration. The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail and the informant has sustained simple injury.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order

Patna High Court Cr.Misc. No.51972 of 2017 (2) dt.09-11-2017 3/3 shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Deo P.S. Case No. 50 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
