1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Gaurichak Police Station Case No. 805 of 2022, dated 02.12.2022, disclosing offences under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act.
3. The prosecution case, as per the First Information Report, is that during night patrolling on 01.12.2022, received secret information from the Excise Prohibition Unit regarding transportation of foreign liquor in a white Tata Safari. Upon the said information, the police team reached at the place of occurrence and intercepted the said vehicle, bearing Registration No. BR01CZ-0005. It

No.18562 of 2026(2) dt.08-04-2026 2/3 has been alleged that upon search of the vehicle, a total of about 2.680 litres of foreign liquor was recovered from beneath the seat, and two persons, namely, Aryan Kumar and Monu Kumar Singh, were apprehended and illicit liquor and vehicle was seized.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case merely because she happens to be the registered owner of the said vehicle. He next submits that the vehicle, from where illicit liquor has been recovered, was being driven by petitioner's husband namely, Monu Kumar, who was arrested from the spot and the petitioner had no knowledge about illicit liquor being kept therein. The petitioner has got no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner has been made accused merely because she happens to be the registered owner of the vehicle, which was being driven by her husband and was arrested from the spot, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City, in connection with Gaurichak Police Station Case No. 805 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
