The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 392 of the Indian Penal Code. Subsequently, section 411 of the Indian Penal Code was also added.

Prosecution case is that the informant being the driver of the truck was carrying biscuits loaded from Sona Biscuits Limited, Industrial Area, Hajipur, but the truck was robbed. Though, the FIR was registered against unknown but on arrest of one Satyent Kumar, it was found that 50 packets of biscuits were sold by him to co-accused Nawal Paswan when coaccused Nawal Paswan was apprehended, he suggested that he sold nine packets of biscuits to the petitioner Bhola Pandit and

Patna High Court Cr.Misc. No.24345 of 2016 (2) dt.31-05-2016 2/2 the same have been recovered from the possession of petitioner Bhola Pandit.

It is submitted by learned counsel for the petitioner that recovery of biscuits does not suggest that the petitioner robbed the truck. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts may constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Vaishali P.S. Case No. 60/2016, pending before the learned CJM, Hajipur at Vaishali. With the above observation, this application is, accordingly, disposed off.
