JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioners are not named in the first information report and perusal of impugned order goes to show that learned court below rejected the bail prayer of the petitioners only on the ground of their criminal antecedent.

Learned counsel appearing for the petitioners submits that as a matter of fact, there is no legal evidence against the petitioners.

No.43405 of 2018 (2) dt.19-07-2018 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 328 of 2018.
