The petitioner is apprehending arrest in a complaint case filed with accusation under sections 452,323,504,427,354 and 149 of the Indian Penal Code.

The prosecution case is that the complainant was alone in the house when the petitioner being her nephew, entered into the house and assaulted with fists and slaps. It is submitted by the learned counsel for the petitioner that in the background of property dispute the accusation has been levelled. It is further submitted that for the

Patna High Court Cr.Misc. No.24147 of 2016 (2) dt.31-05-2016 2/2 occurrence of 12.4.2012 at 5 P.M. the complaint was filed on 13.4.2012. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Complaint Case No. 135 C of 2012 pending in the court of learned CJM, Sheikhpura. This application is disposed of with the aforesaid observation/direction.
