The petitioner apprehends his arrest in Kazi Mohammadpur P.S. Case No.96 of 2015 registered under Section 366A of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner is innocent. The petitioner solemnised marriage with the victim and he has got two children from the wedlock. The petitioner and the victim are living happy conjugal life but it appears that case is of the year 2015. Earlier also, the case was lodged against the petitioner in the year 2014 for kidnapping the daughter of the informant. On the date of occurrence, the victim was minor. The petitioner moved this Court after five years from the date of institution of the F.I.R.

Patna High Court CR. MISC. No.15334 of 2020(2) dt.10-09-2020 2/2 Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this Court and taking into consideration the fact that case has been compromised.
