The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

The prosecution case, in short, is that the Bolero vehicle of the informant has been stolen from vegetable market in the night of 24.04.2018.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.06.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has come on the confessional statement of co-accused Santosh Yadav. There is no recovery of any incriminating article

Patna High Court Cr.Misc. No.50355 of 2018(2) dt.13-09-2018 2/2 from the possession of the petitioner. The petitioner has not been put on Test Identification Parade.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Mrs. Ankita Jaiswal, learned Judicial Magistrate, 1st class, Khagaria in connection with Mahesh Khut P.S. case No.50 of 2018.
