Having regard to the nature of allegation against the petitioner for offence under Section 363, 366(A) 34 of the Indian Penal Code and the fact that the victim Pooja Kumari in her statement under Section 164 of the Cr.P.C. had clearly made a statement that it was the petitioner Kundan Kumar who had kidnapped her, this court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly the prayer for anticipatory bail of the petitioner, namely, Kundan Kumar is rejected. Nothing said in this order, however, will prejudice the petitioner in surrendering and making prayer for regular bail. (Mihir Kumar Jha, J) Rishi/- U T
