Mr. SRI HARENDRA PRASAD ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 15-01-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with N.T.P.C. P.S. Case no. 42 of 2017 registered for the offences punishable under Sections 365, 386 and 387 r/w 34 of the Indian Penal Code.
Allegation against petitioner is that he forcibly got the cheque signed in favour of him of Rs. 90,000/- and went to encash the same from the bank. Meanwhile, police was informed and he was caught in the bank.
It has been contended by the learned counsel for the petitioner that he is innocent and has falsely been implicated in this case. Both petitioner and informant are contractors and Rs.90,000/- was due against petitioner for which he (informant) had issued the cheque. It has further been submitted that
Patna High Court Cr.Misc. No.59040 of 2017(2) dt.15-01-2018 2/2 petitioner has no criminal antecedent and is in jail custody since 12.08.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur, in connection with N.T.P.C. Case no. 42 of 2017 (G.R. no. 3943 of 2017).
