JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 380, 384, 386, 406, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that the accused persons including the petitioner wanted to disposes the informant from his land and in furtherance of the said object they cut away the paddy crop of the informant from his land and on protest being made they threatened and demanded extortion. The accused persons also resorted to fire in the air. It is submitted by learned counsel for the petitioner that petitioner is own brother of the informant and in the background of civil nature of litigation between the parties from before the present accusation has been levelled. The accusation is not specific against the petitioner. Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.24425 of 2016 (2) dt.31-05-2016 2/2 before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj P.S. Case No. 46 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
