JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody since 31.10.2021 in a case registered for the offences punishable under Section 394 of the Indian Penal Code. It is a case of robbery of Rs. 308610/- by four unknown miscreants. The accused persons also took away Hero Honda Motorcycle.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R is against unknown. It is further submitted that neither petitioner

Patna High Court CR. MISC. No.18447 of 2022(3) dt.02-01-2023 2/2 was apprehended from the spot nor anything has been recovered from the conscious possession of the petitioner and only on suspicion the petitioner has been roped in the present case. The petitioner is in custody since 31.10.2021.

Considering the facts stated above and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 916 of 2021.
