JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-12-2018 After some arguments, the learned counsel for the petitioner seeks to withdraw the present writ petition with liberty to file objection under section 9 of the Bihar & Orissa Public Demands Recovery Act in the ongoing Certificate Case No. 01 of 2015-16 pending before the Certificate Officer, East Champaran at Motihari.

Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file fresh objection taking all such points as have been taken in the present writ petition. In case such objection is filed within six weeks from

Patna High Court CWJC No.10640 of 2016(2) dt.03-12-2018 2/2 today, the Certificate Officer, East Champaran at Motihari shall pass a final order under Section 10 of the Bihar & Orissa Public Demands Recovery Act.

Till the time the final order is passed, no coercive steps shall be taken against the petitioner herein. It is needless to state that in case no objection is filed within a period of six weeks from today, the Certificate Officer shall proceed ex parte.
