KUMAR ORAL ORDER 27-07-2018 Petitioner is permitted to correct the prayer portion of the petition in the year of P.S. Case in course of the day. Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Phenhara P.S. Case No. 91 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.

Informant has alleged in his written complaint that he was returning from Phenahara Bazar and on the way stopped his motorcycle for urinating. In the meantime, three persons on a black colour motorcycle without registration number stopped there and one of them took away his

Patna High Court Cr.Misc. No.45677 of 2018(2) dt.27-07-2018 2/2 motorcycle. FIR has been registered against three unknown persons. The name of the petitioner has transpired in this case on the basis of confessional statement made by co-accused Bhikhari Rai and Arun Kumar Sahani. The stolen motorcycle has been recovered from possession of one Madhurendra Singh @ Madhu Singh. Nothing has been recovered from the possession of petitioner and he is in custody since 22.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 12th Additional Chief Judicial Magistrate, at Motihari, East Champaran, in connection with Phenhara P.S. Case No. 91 of 2017.
