JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-07-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Saharghat Police Station Case No. 04 of 2016, disclosing offence under Sections 341, 323, 324, 307, 354, 379, 504 of the Indian Penal Code.
The informant is the wife of the elder brother of the petitioner. It is evident from the First Information Report that because of some family dispute over property, the occurrence had taken place, leading to lodging of the case and counter case.
It is alleged against the petitioner that he assaulted the informant with tangari (sharp-cutting weapon). He has submitted that the petitioner's side also
Patna High Court Cr.Misc. No.24990 of 2016 (4) dt.15-07-2016 2/2 received various injuries. The petitioner has no criminal antecedent.
Considering the genesis of occurrence and nature of dispute between the parties, this application is allowed.
Let the petitioner, Akhileshwar Thakur @ Akhilesh Thakur, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Benipatti, Madhubani, in connection with Saharghat Police Station Case No. 04 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
