JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 14.06.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bihta P.S. Case no. 517/2015 registered under section 307 and other minor sections of the Indian Penal Code and 27 of the Arms Act.

The only allegation against the petitioner is that he opened fire while informant and others were fleeing but admittedly, no one sustained any firearm injury. Learned counsel for the petitioner submits that the petitioner is a constable in Bihar police and, as a matter of fact, he has been implicated in this case falsely.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition

Patna High Court Cr.Misc. No.24783 of 2016 (2) dt.14-06-2016 is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur, Patna in Bihta P.S. Case no. 517/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
