Patna High Court CWJC No.5750 of 2023(2) dt.16-10-2023 2/3 ORAL ORDER 16-10-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of writ/writs, order/orders, direction/ directions in the nature of mandamus directing the respondents to immediately remove the illegal encroachment over the Gair Mazarua public land pertaining to Mauza Atmi, Khata No584/585, Khesra No-3417, Thana No-422, Total Rakwa/Area- 29 and Khesra No-3456 Total 97 dismal land which land is purely Gair Mazarua public Land used for public Road/Rasta and the following land which is encroached by the Respondents No-7 to 13 and the said land under Jamabandi running in the name of Anabad Bihar Sarkar.

(ii). For further the respondents may be directed to take appropriate action for restoration of public use over the aforesaid land.

(iii). For further direction upon the respondents particular the Respondent No-5 and 6 to immediately remove the illegal encroachment over the Anabad Bihar Sarkar (Gair Mazarua public Land) Land which is encroached by the Respondent No-7 to 13."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer,

Patna High Court CWJC No.5750 of 2023(2) dt.16-10-2023 3/3 Nawanagar, District-Buxar, for redressal of their aforesaid grievances. Liberty, so sought, is granted.
