JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 324, 341, 447, 504, 34 of the Indian Penal Code. It is alleged that petitioner and one Bishundeo Singh assaulted the informant with farsa and sword repeatedly on the leg, head and hand of the informant. It is submitted by learned counsel for the petitioner that injury report reflects three injuries out of which injury No. 1 has been found caused by sharp cutting weapon whereas injury Nos. 2 and 3 have been found caused by hard and blunt substance and out of which injury No. 2 has been found to be grievous. It is further submitted that there is counter version of the occurrence also.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that only one injury

No.31550 of 2015 (2) dt.05-08-2015 2/2 has been found to be sharp cut injury whereas it is alleged that petitioner and co-accused both made assault with sharp cutting, moreover, the grievous injury has been caused by hard and blunt substance, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 30 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
