ANJANA PRAKASH ORAL JUDGMENT Date: 21-06-2016 The petitioner seeks quashing of the order of cognizance dated 07.09.2013 passed by the Judicial Magistrate, 1st Class, Jhanjharpur in Phulparas P.S. Case No. 317 of 2012, Tr. No. 3133 of 2013.

The case of the complainant is that the accused person took his LTI on plain papers and took loan on the basis of such papers. It has been submitted that the occurrence is said to be of the year 2004 whereas the case has been instituted in the year 2012 which points to the malafide of the informant. On the last occasion notices had been issued to the Opposite Party no. 2 but none appears on her behalf. Having considered the aforesaid, the application is allowed and further proceedings including the order of cognizance

Patna High Court Cr.Misc. No.54000 of 2013 dt.21-06-2016 2/2 dated 07.09.2013 passed by the Judicial Magistrate 1st Class, Jhanjharpur in Phulparas P.S. Case No. 317 of 2012 Tr. No. 3133 of 2013 is hereby set aside.
