JUSTICE BIRENDRA KUMAR ORAL ORDER 05-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Kadamkuan P.S. Case No.324 of 2017, a case under Section 379 of the Indian Penal Code.

The F.I.R. of the occurrence of theft is against unknown. The petitioner has stated on oath that he has got no criminal antecedent. The petitioner is in custody since 01.08.2017.

Submission is that petitioner has not put on Test Identification Parade nor anything has been recovered from the possession of the petitioner.

Considering the aforesaid fact, let the petitioner,

Patna High Court Cr.Misc. No.57361 of 2017 (3) dt.05-01-2018 P2/ above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kadamkuan P.S. Case No.324 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
