Having regard to the nature of allegation for offence under Section 147, 149, 341, 323, 324, 307, 504 of the Indian Penal Code and Section 3(X)) of the S.C./S.T. act, this Court, in view of the specific allegation of the informant against the petitioner to have caused injury on the person of the injured informant that it was the petitioner who along with one Sanjay Rai had assaulted with Chaku (knife), is not inclined to grant anticipatory bail to the petitioner only because learned counsel for the petitioner highlights that in the injury report, there is no incised injury. This Court cannot ignore the fact that a knife is also capable of causing penetrating injury and that has been found on the person of the informant in the injury report. That being so, the prayer for anticipatory bail of the

Patna High Court Cr.Misc. No.36735 of 2014 (2) dt.09-04-2015 petitioner, namely, Ranjeet Rai @ Ranjeet Kumar Rai is hereby rejected.

Nothing said in this order, however, will come in the way of the petitioner in surrendering and making prayer for regular bail which will be considered on its own merit without being prejudiced by any thing said in this order. (Mihir Kumar Jha, J) Rishi/- U T
