JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 2822 C of 2014 in which prima facie case has been found for the offences punishable under Sections 323, 341, 504, 379, 354 of the Indian Penal Code and seeks bail on two grounds. Firstly, the victim was not examined by the enquiry court and secondly, the mother of the petitioner lodged Palasi P.S. Case No. 193 of 2014 against one Md. Mosim and others on 21.08.2014 and in retaliation to the aforesaid criminal case, the aforesaid Md. Mosim, who happens to be father in law of victim of the present

Patna High Court Cr.Misc. No.28498 of 2015 (2) dt.23-07-2015 case set up the mother of his daughter in law and got instituted the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri S.K. Singh, Judicial Magistrate 1st Class, Araria in Complaint Case No. 2822 C of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
