The petitioner seeks regular bail in connection with Basopatti P.S. Case No. 296 of 2018 for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of 216 liters of illicit liquor from two motorcycles, one of which was being driven by the petitioner.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 27.12.2018. Having regard to the facts and circumstances of the
Patna High Court CR. MISC. No.16670 of 2019(2) dt.01-04-2019 2/2 case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Special Judge (Excise), Madhubani in connection with Basopatti P.S. Case No. 296 of 2018, G.R. No. 2038 of 2018.
