2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 326 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per allegation in the FIR, petitioner took out a pistol from his waist and fired upon the shoulder of the informant.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to political rivalry.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.22819 of 2024(2) dt.29-04-2024 2/2 anticipatory bail of the petitioner.
6. On perusal of the first information report and impugned order dated 13.02.2024, it appears that the witnesses have supported the prosecution case and photo copy of the injury report is attached with the case diary which shows that the injured sustained four fire arm injuries caused by fire arm and the nature of injuries as opined by the doctor as grievous and there is direct and specific allegation of causing repeated fire arm injury to the informant, considering which, I am not inclined to grant bail to the petitioner.
7. Prayer for anticipatory bail of the petitioner is hereby rejected.
