In this case, petitioners are seeking bail in connection with Bakhtiyarpur P.S. Case No. 61 of 2014 registered for offences under sections 143, 323, 341, 325, 354, 427, 436, 504, 506 of the Indian Penal Code and Section 3(1) (X) SC/ST(POA) Act.
Allegation in the first information report has been made that the victim and his associates were singing Chaita near his house, for that reason they were abused and assaulted. The counsel for the petitioners has taken a plea that the informant and his associates demanded money for Chaita and
Patna High Court Cr.Misc. No.39854 of 2014 (2) dt.04-03-2015 2/2 when petitioners refused, the informant and his associates started singing in loud voice whereupon they were prevented on the ground of illness of father of the petitioners, in retaliation, the present case has been filed. The counsel for the petitioners has also drawn attention to the joint application filed before the Magistrate showing that they have settled the dispute outside the Court.
Looking to the facts and circumstances of the case, in the event of petitioners' arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named petitioners be released on bail on their furnishing bail bonds of Rs. 10,000/- (ten thousand) each two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh (Patna) in connection with Bakhtiyarpur P.S. Case No. 61 of 2014.
