1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Korma P.S. Case no.92 of 2024 registered under sections 126(2), 115(2), 118(1), 117(2), 118(2), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and sections 3 and 4 of the Prevention of Witch (DAAIN) Practices Act, 1999.
3. As per the prosecution case, it is stated that 12 named accused persons including the petitioner herein as also one Nandu Saw came variously armed. It is further stated that on the orders of Ram Chander Saw, Nandu Saw assaulted the informant on his head with a sword while specific allegations of assault has been made against Vicky Saw, Mukesh Saw and
Patna High Court CR. MISC. No.20004 of 2025(2) dt.23-04-2025 2/3 Naveen Kumar. It is further stated that the petitioner along with three other also assaulted with lathi.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. There is case and counter case between the parties the case from the side of the petitioner having been lodged earlier in time. It is submitted that so far as this petitioner is concerned, the allegations are general and omnibus in nature. The case of the petitioner stands on a better footing to that of co-accused Nandu Saw who has been enlarged on bail vide order dated 19.2.2025 passed in Cr. Misc. no.7530 of 2025. The petitioner has no criminal antecedent and is in custody since 22.12.2024.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the submissions made by learned counsel for the petitioner, grant of bail to co-accused Nandu Saw vide aforesaid order dated 19.2.2025, the petitioner having remained in custody since 22.12.2024, not having any criminal antecedent and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with
Patna High Court CR. MISC. No.20004 of 2025(2) dt.23-04-2025 3/3 Korma P.S. Case no.92 of 2024, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, Sheikhpura.
