This is an application for bail in connection with Kotwali P.S. Case No. 325 of 2017 registered for the offences punishable under Sections 418, 419, 420, 327, 328, 379 and 411/34 of the Indian Penal Code.

Allegation against the petitioner is of cheating the informant of Rs.12,000/- by the petitioner along with others. Submission of learned counsel for the petitioner is that there is no recovery from the possession of the petitioner and he is in custody since 4.7.2017, having no criminal antecedent. Furher submission is that similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide orders dated 17.10.2017 and 19.9.2017 passed in Cr.Misc.Nos. 49822 and

Patna High Court Cr.Misc. No.61613 of 2017 (3) dt.11-01-2018 2/2 45580, both of 2017.

Having heard both sides and in the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Kotwali P.S.Case No. 325 of 2017 and before releasing him on bail the court below will verify criminal antecedent of the petitioner and if it is found that petitioner has criminal antecedent then this order has no effect, otherwise subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in trial and appear in court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
