The petitioner seeks bail in Nasariganj P. S. Case No. 122 of 2006 instituted for the offence under Section(s) 121(A), 122, 124(A) Indian Penal Code and Section 17 of C.L.A. Act. Petitioner is in custody since 24.1.2011.

As per the FIR, the name of this petitioner was disclosed by accused persons who were apprehended by the police. There is no recovery of incriminating article from his possession.

It is alleged in the FIR that informant got information that the members of MCC was going to do a meeting at Bardihan Primary School. The police party reached at the place of occurrence and arrested four accused persons along with

Patna High Court Cr.Misc. No.49927 of 2018(2) dt.01-10-2018 2/2 the incriminating articles who have admitted that they are members of the MCC. Seizure list was prepared. Those four accused persons disclosed the name of this petitioner and other accused persons who fled away.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge VII, Rohtas, Sasaram, in connection with Nasariganj P. S. Case No. 122 of 2006, Sessions Trial no. 532 of 2016 subject to the condition that both the bailers shall be the close relative of the petitioner.
