JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.12.2016 seeks bail in Parbatta PS Case No. 297 of 2016 registered under Sections 25(1b)a, 26 and 35 of the Arms Act. Accusation is that one country made pistol with three live cartridges were recovered from the possession of the petitioner. Learned Counsel for the petitioner submits that the recovery is fabricated and the petitioner has remained in custody for more than a year and seven months but still charge has not been framed. Having considered the said facts and circumstances, specially the period of detention, the petitioner, namely, Guddu Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM I, Khagaria in connection with Parbatta PS Case No. 297 of 2016.
