The petitioner seeks bail in Bochahan P.S. Case No. 175 of 2017 registered under Section 399, 402, 414 of the Indian Penal Code and Section 25 (1-b)a/26/35 of the Arms Act. As per the prosecution case, one loaded country made pistol and two mobiles is said to have recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He is a student of B.A. History (Hons.) and has been falsely implicated in this case at the instance of his enemies planting the said fire arms in question with him. Patna High Court Cr.Misc. No.54286 of 2017 (02) dt.13-12-2017 - 2 - hampered. The petitioner has been languishing in custody since 28.08.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-XI-cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Bochahan P.S. Case No.175 of 2017.
