====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 276, 419, 420 of the IPC, 18(A), 18(B), 18 (C), 27(b)(II), 28 and 28(A) of the Drugs and Cosmetics Act.

The prosecution story, in brief, is that the informant got knowledge from S.H.O. P.S. Sultanganj that Vikram Choudhary @ Vicky (petitioner) is selling restricted medicines secretly. He alongwith patrolling party reached at his shop where in presence of two independent witnesses, it was searched and recovered a total of 72 glass bottles filled with restricted syrups.

Patna High Court CR. MISC. No.15450 of 2020(2) dt.03-03-2020 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 29.01.2020. The petitioner has got no criminal antecedent. He has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. 72 bottles syrup is said to have been recovered from the shop of the petitioner. There is no compliance of Section 100 of Cr. P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-Ist-cum-Special Judge, Bhagalpur, in connection with Drugs and Cosmetics Case No. 01 of 2020, arising out of Sultanganj P.S. Case No. 16 of 2020.
