JUSTICE RAVI RANJAN ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner apprehends his arrest in a case filed under Sections 461 and 379 of the Indian Penal Code. It is submitted that F.I.R. is against unknown persons. However, petitioner's name has cropped up in view of the confessional statement of co-accused Baidynath Sadai and except that there is nothing against him. He submits that in fact the confession has been made in different case i.e., Rajnagar P.S. Case No.52/2013.

Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Raj Nagar P.S. Case No.38 of 2013 dated

Patna High Court Cr.Misc. No.37164 of 2014 (2) dt.27-03-2015 2 / 2 08.03.2013, the above named petitioner, Raja Ram Yadav shall be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of J.M. Ist Class, Madhubani subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that one of the bailors of the petitioner must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
