JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Danapur P.S.Case no.118 of 2015 for the offences under Sections 498(A) and 307/34 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution case, in short, is that the marriage of the informant was solemnized with the petitioner in the year 2002.The informant has been blessed with one son and one daughter. Since 2 to 3 years her in-laws people including petitioner have been torturing her because of the fact that her husband has got illicit relation with another lady, namely Mala Goswami. On 5.12.2014 when the informant was preparing meal

No.28749 of 2015 (2) dt.23-07-2015 2/2 in the kitchen at about 8 A.M. her husband alongwith Mala Goswami came and sprinkled kerosene oil on her body and lit fire as a result of which she sustained burn injury. It has been submitted on behalf of the petitioner that the petitioner is ready to keep the informant but the same is not acceptable to her. It is further submitted that the petitioner is ready to deposit a sum of Rs.3000/- per month before the court below which shall be released in favour of the informant. On behalf of the State it has been submitted that the petitioner is named in the F.I.R. who is husband of the informant. Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit Rs.

3000/- per month which shall be released in favour of the informant and on doing so let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M.,Danapur, Patna, in Danapur P.S. Case No.118 of 2015 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
