The petitioner seeks bail in a case registered for offences under Sections 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 9.720 litres of foreign liquor was recovered from the bag which was being carried by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 28.09.2017.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be

Patna High Court Cr.Misc. No.53354 of 2017(2) dt.09-11-2017 2/2 released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV-cum-Special Judge, Excise, Kaimur at Bhabhua in connection with Excise Case No. 1535 of 2017 (Excise P.R. No. 112 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
