JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Sathi P.S. Case No. 190 of 2018, disclosing offences under Sections 341, 323, 354(B), 379, 384, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioners is of coming variously armed, thrashing the informant on the ground and also of assaulting by fists and slaps and further allegation of demand of Rangdari of Rs.50,000/- Submission of learned counsel for the petitioners is that three days earlier lodging of this case, a case has also been lodged against the informant and others by petitioner no.1 and
Patna High Court CR. MISC. No.19732 of 2019(2) dt.07-05-2019 2/2 with respect to that the present case has been lodged in order to save their skin and no injury is available on the record. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Sathi P.S. Case No. 190 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
