JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 06-04-2017 Seeking exception to an order dated 26.05.2016 passed by the learned writ court in C.W.J.C No. 8516 of 2016, this appeal has been filed under clause-10 of the Letters Patent. A tender was published by the Bihar Karamchari Chayan Ayog, for removal of old boxes. The appellant was one of the person who submitted his tender and contends that in spite of the fact that he was the lowest bidder, his tender was not accepted. It was
Patna High Court LPA No.1275 of 2016 dt.06-04-2017 2/2 mentioned in the bid that each of the tenderer was required to remain present even though the persons including the appellant submitted the bid. When the bid was opened the petitioner was absent and in his absence the tender has been finalized.
We see no error in the order of the learned writ court warranting reconsideration, apart we find that the tender for removal of old boxes was awarded and finalized as per the terms and conditions of the agreement. That being so no other indulgence in the matter is called for.
The appeal is, accordingly, dismissed.
