JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Motihari Muffasil P.S. Case No. 99 of 2014 registered for the offence punishable under Section 304 of the Indian Penal Code. The accusation against the petitioner is that he gave injection to the informant's son as a result thereof, informant's son died then and there.

Learned counsel appearing for the petitioner submits that petitioner is a local compounder and even if it assumed that petitioner gave injection to the deceased, then also, petitioner had given only preliminary medical help to the deceased. It is further

Patna High Court Cr.Misc. No.2427 of 2015 (3) dt.23-06-2015 contended by him that cause of death of the deceased could not be ascertained.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Motihari Muffasil P.S. Case No. 99 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
