ANJANA MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.07.2017 in connection with Jogbani (Bathnaha) P.S. Case No.111 of 2001, corresponding to S.T. No.289 of 2003, registered for the offence under Section 25(1-b)a, 26 II, 35 of the Arms Act. The present case is of misuse of privilege of bail. Learned counsel for the petitioner submits that due to certain circumstances beyond the control of the petitioner and that for want of necessary Pairvi, the petitioner could not present himself, which has resulted in the present situation. He further submits that at a future date, the petitioner shall be present in order to see that the trial reaches its logical

Considering the entire facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned F.T.C., Araria, in connection with Jogbani (Bathnaha) P.S. Case No.111 of 2001, corresponding to S.T. No.289 of 2003. It is made clear that if the petitioner abstains from the court on two consecutive dates without sufficient cause and without the liberty of the court, the order passed today shall stand revoked automatically.
