JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 364, 370, 302, 201/34 of the Indian Penal Code.
The allegation against the petitioner is that he took the son of the informant, namely,Vikas Kumar aged about 16 years to Manipur with assurance of his job on the salary of Rs. 3000/- per month and petitioner gave Rs. 1000/- to the complainant. After lapse of one year accused gave Rs. 20,000/- to complainant but the complainant could not be got contacted with his son. The complainant has suspicion that accused persons under conspiracy committed the murder of his son and disappeared his dead body or to sell his son.
Patna High Court Cr.Misc. No.28796 of 2015 (2) dt.27-07-2015 2/2 On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. The petitioner has been named in the present case merely on the basis of suspicion and local village politics. There is no eye witness to the occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Vaishalia t Hajipur in connection with Patepur P.S.Case No. 39/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
