JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2021 The learned counsel for the petitioner submits that since he could not appear before this Court on 11.9.2019, he was not aware about the time granted to the petitioner for removal of the defects, hence, the defects could not be removed, thus, the petition in question stood dismissed on account of non-compliance of the peremptory order dated 11.9.2019.

The learned counsel for the RespondentState, Ms. Divya Verma (AC to AAG-3), has not objected to the prayer of the petitioner for restoration of the present petition.

Having regard to the facts and circumstances of the case and considering the

Patna High Court MJC No.1003 of 2021(2) dt.03-11-2021 2/2 submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for restoration of the said petition bearing MJC No. 3655 of 2019 to its original file, subject to removal of the defects, pointed out by the stamp reporter/ the registry, within a period of eight weeks from today by physical mode.
