The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

The prosecution case in short is that while the informant was engaged in his job, three persons wrapping their cases entered the premises and demanded key of the Almirah and money from him. It is also alleged that Rs. 193165/- was taken away by the accused persons. The informant was assaulted also. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 06-092018. Charge sheet has already been submitted. The petitioner is not named in

Patna High Court CR. MISC. No.20349 of 2019(3) dt.12-04-2019 2/2 the FIR. His name transpired in this case on the basis of confessional statement of co-accused. There is no recovery of any incriminating article from possession of the petitioner. The other co-accused with similar allegation has been granted anticipatory bail by a coordinate bench of this court vide order dated 26-09-2018 passed in Cr. Misc. No. 33387 of 2018. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-XI, Rohtas at Sasaram in connection with Sessions Trial No. 25 of 2019 arising out of Bikramganj P.S. Case No. 08 of 2018.
