JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2025 Heard learned counsel for the petitioner, learned A.P.P for the State and learned counsel for the informant.

2. The petitioner apprehends his arrest in Fatuha P.S. Case No. 191 of 2024, registered for offence under Sections 341, 323, 307, 302 r/w section 34 of the Indian Penal Code and section 27 of the Arms Act.

3. The informant has alleged that on 26.03.2024 on the eve of Holi, all the F.I.R. named accused persons including this petitioner, after forming an unlawful assembly, assaulted informant's father, leading to his death.

4. Learned counsel for the petitioner submits that present case is counter blast of Fatuha P.S. Case No. 189 of 2024, which was lodged by Geeta Devi, wife of Yogendra Singh

Patna High Court CR. MISC. No.18788 of 2025(2) dt.18-04-2025 2/3 @ Sadhu Ji against the informant and others. He next submits that specific allegation of assaulting the deceased by iron rod causing injury on his head is against co-accused Ranjeet Kumar. So far as this petitioner is concerned, he is also alleged to have assaulted along with other accused persons when the injured fell. There is no specific allegation of assault against this petitioner.

Learned A.P.P. for the State and learned counsel for informant vehemently opposed the prayer for anticipatory bail and submitted that in the F.I.R., there is specific allegation that this petitioner alongwith other co-accused assaulted the injured when he fell down. The post-mortem report also reveals that the injured suffered four external injuries, which goes to show that co-accused Ranjit Kumar was not alone in assaulting the deceased. The prayer for anticipatory bail of similarly situated co-accused Sintu Kumar @ Sintu Singh has already been rejected by a coordinate Bench of this Court, vide order dated 17.12.2024 passed in Cr.Misc. No. 62937 of 2024. Petitioner has also got two criminal antecedent.

6. Considering the nature of accusation, criminal antecedent and the fact that prayer for anticipatory bail of similarly situated co-accused Sintu Kumar @ Sintu Singh has
