After some argument learned Counsel for the parties have jointly submitted that the issues arising in this writ application are directly dependant upon determination of disputed questions of fact which cannot be done in the jurisdiction under Article 226 of the Constitution of India. Learned Counsel for the parties have further submitted that without going into merits, this writ application may be disposed of with liberty to the aggrieved party to approach the Civil Court for redressal of his grievance.
3. In view of the aforesaid submission and stand by the
Patna High Court CWJC No.10656 of 1997 dt.30-07-2015 learned Counsel for both the parties without going into the merits, this writ application is disposed of with liberty to the aggrieved party to seek redressal of their grievances in accordance with law before the Civil Court of competent jurisdiction.
